Core Terms & Conditions for Daniel's Painting and Decorating
1. Scope of Work & Pricing
- Fixed Quote: The price for the project is a fixed cost as described in the quotation, not a daily rate. The cost is certain unless changes are agreed upon and confirmed in writing.
- Variations: Any requested changes or additions to the work must be agreed upon and confirmed in writing by both parties, and will likely result in an adjustment to the price.
2. Standard of Workmanship
- Preparation: Surfaces will be prepared (e.g., filling holes, cracks, dents) before painting or wallpapering.
- Imperfections: The company often states that while every effort is made for a smooth finish, they cannot guarantee a perfectly smooth/flawless finish unless re-plastering was explicitly agreed upon. This is a common clause, especially when repairing existing damage.
- Hand Application: The company uses hand application (roller or brush), which means minor imperfections are expected, unlike spray application used in new-build homes.
- Contaminants: The finish cannot be guaranteed if there are contaminants present, such as silicon, wax, damp, or salts on the surface.
- Exterior Work: For outside work, some dust or particles adhering to the paint is expected and cannot be controlled without costly protective hoarding.
3. Definition of a Satisfactory Finish
A painted surface is generally considered satisfactory if it meets these criteria:
- It is reasonably smooth, free from large nail holes, cracks, and splits.
- It is reasonably uniform in colour, texture, and finish.
- Surfaces are typically viewed in daylight from a distance of 2 meters with wall lights/uplights switched off. (This is a standard industry test for quality.)
4. Guarantees and Liability
- Work Guarantee: They offer a 6 month guarantee on all completed work.
- Client Obligation (Possessions): The customer is responsible for removing all personal and valuable items from the work area. The company will not be liable for damage to items that were not removed.
- Existing Substrate: The company is not liable if a failure or defect is caused by a problem in the underlying substrate or a previous coating (e.g., if old plaster fails beneath the new paint).
5. Payment and Cancellation
- Deposits: A deposit payment (often 20% or 30%) is typically required to secure the booking. This deposit is generally non-refundable upon cancellation.
- Payment Terms: Full payment of the remaining balance is usually due immediately upon completion of the work.
